CANADA OWNER OPERATOR LMIA

This category is for foreign nationals who wish to establish or purchase a business in Canada, and want to work in that business in a high-skilled position, often with the aim of immigrating permanently. This program is ideal for foreign nationals who meet the requirements of the Federal Express Entry but does not have enough points to receive Invitation to Apply. Those who have CRS points with at least 250 may consider this program.

REQUIREMENTS of the Program:

Basic Requirements:

1. Minimum 1 year of skilled work experience (prefer management experience);
2.Minimum CLB 7 (IELTS 6);
3.Minimum high school graduate;
4.Minimum CRS points of 250 on Express Entry pool.

 

Other Requirements:

1.A business plan that shows at least 50% ownership in the business and how the owner/operator will fund the business and create or maintain employment and contains at least a rudimentary financial plan and timeline of events;
2. A proposal to employ at least one Canadian or permanent resident (a minimum of 3 including a middle manager for a senior managerial position – NOC 00).

 

Path to PERMANENT RESIDENCE:

CRS points (Federal Express Entry) awarded for job offers (including those based on Owner/Operator LMIAs) – 200 points for senior managerial positions (NOC 00__) and 50 points for all other O, A, B positions.

 

OPTION #1 –

Any applicants who are eligible for one of the Federal Express Entry Programs (Skilled Workers, Skilled Trades, or Canadian Experience Class) can get additional points by obtaining Owner Operator LMIA (no need to actually set up the business but at least a lease is required) enough to receive Invitation to Apply.

 

OPTION #2 –

If only 50 points (not a senior manager position) is granted with still not enough points to receive Invitation to Apply, potentially additional 78 points can be granted after operating the business for 1 year – Then becomes eligible to receive Invitation to Apply.

 

OPTION #3 –

The spouse can find a sponsor in Canada with an open work permit – can apply under one of the PNP programs.
